President Trump’s national emergency declaration is an affront to the Rule of Law. Article I, Section 8 of the Constitution gives to Congress alone the power to raise and spend money, and Article I, Section 9 declares, “No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law.”
The emergency powers that Congress gave to the president are exceptions to the normal constitutional order, and President Trump is abusing those exceptions in defiance of the separation of powers.
Using emergency powers in defiance of Congress sets a terrible precedent. Once a Republican president expresses contempt for the Constitution, it invites a Democratic president to even more egregious violations of the people’s representatives in Congress. This is the kind of behavior typically seen in banana republics, not the world’s greatest republic and sole superpower.
Every member of Congress swears an oath to “support and defend the Constitution of the United States” and to “bear true faith and allegiance to the same.” This means every member of Congress is duty bound to defend the separation of powers and the Rule of Law. Congress must assert its constitutional power to overturn the president’s emergency declaration.
